They should accept application received by May 31. However if the lawyer sent it on May 31, it would most likely not reach them on the same day. If USCIS receives it on June 1, they may not accept it. The lawyer should try to send it as early as they can.

Since I dont know the complete case details, it would be helpful to talk to a good lawyer. In short, she has to maintain legal status. Else it can trigger a 3 year or 10 year ban. She can definitely go on F1 visa even if she has masters degree. If she is on F1 visa, she can maintain legal status. This may be the best option. A good lawyer can review your complete case details and provide best guidance.

1. If GC is already issued, it does not matter if dates retrogress later. 2. Are you talking about immigrant visa or non-immigrant visa? Non-immigrant visa have a fixed validity date.
