I paid AOS Fee now prepared AOS FILE BUT
My petetioner have not done job last year so
She did not file her last tax return now what
Should we do to file AOS
If you see section 7, it says that you can submit last three years of tax return if the latest tax return is not sufficient proof.

Also as you know, your spouse has to file the tax return.
But amazon my wife arrived at USA first time in july 2012 thru f4 immigrant visa.
Then in october2012 she came back my country to marriage with me.
Return at USA march2013. So she did not file tax return. Can she file "NILL" return now?
Actually the petitioner have to file the tax return. I wasnt sure if it was your or the spouse. BTW, in the link I posted above (I864 instruction form) it gives complete details on what USCIS will accept as proof.

Hi hiren did you get your AOS sorted out actualyl we have the same problem my husband only started working in 2013 and he doesn't get his tax transcript until after april 2014 we filled with joint sponsor but the nvc is asking my husband to submit 2012 tax return even though he wrote them a letter explaining that he did not work in 2012 . how did your wife fill her aos form
Don't worry Molly. Send the letter of explantion again we also send it two times nvc accept it second time

Thank you did you guys receive a checklist also that stated that certain fields had to be competed back and that you should provide 2012 tax returns. It is all so confusing
Yup but you should try submitt 2013 tax return which is available now

@hiren my husband received his w2 and he did electronic filing and their is a printout turbo tax sends you stating that it has been accepted by irs can that work
