Yay!\:d/ I think I found a USCIS link which clearly states the answer to this question
http://www.uscis.gov/files/pressrelease/I_130_07_01_04.pdf
USCIS will adjudicate your Form I-130 prior to visa availability (or within six months if a visa is immediately available upon filing).
sounds to me that yes we can file [biggrin]
What do you think Amazon? The document clearly means to say that for pending I -130 the USCIS will adjudicate your petition based on visa availability .... thank god![-o< [smile]
This is great SweSwe, but this is from 2004.
Hopefully they follow the same policies this time.
That would be fantastic...
I am not sure why some people are still confused about filing I-485 when I-130 is pending.
USCIS allows filing I-485 when I-130 is pending. I may have said this about 50 times in the last one month. o:)
BTW, is there any lawyer who says you cannot file I-485 when I-130 is pending? Also the link Swe posted above talks about what would happen to I-130 petition when visa number is available. It does not talk about I-485 application.
Here are few sources which says you can file I-485 when I-130 is pending:
1. Blog: http://blog.mygcvisa.com/2013/07/fb-category-frequently-asked-questions.html
2. Murthy.com: http://www.murthy.com/2013/07/19/fb2a-current-in-august-2013/
3. USCIS concurrent filing page (though it is not clear)
4. USCIS: http://www.uscis.gov/portal/site/uscis/menuitem.5af9bb95919f35e66f614176543f6d1a/?vgnextchannel=fe529c7755cb9010VgnVCM10000045f3d6a1RCRD&vgnextoid=eb7b5cdc2c463110VgnVCM1000004718190aRCRD
See the column where it says "Where applicable, you must include a copy of the Form I-797C Notice of Approval, showing that your Form I-130 or Form I-360 was accepted or approved."
5. Other lawyers website.
Once you submit I-485 application, USCIS will send I-485 receipt notice in 7-10 business days. See the question ""What happens after I-485 application is filed": http://blog.mygcvisa.com/2013/04/how-to-file-i-485-application.html
This means that USCIS have accepted the I-485 application.
BTW, if you know other people who are still confused, please send them to this page.

Why would it be different:-k they did not release any other public notice or any information after the 2004 public notice was released. So I guess it should be the same case this time around :)
