[/b] sounds to me that yes we can file [biggrin] What do you think Amazon? The document clearly means to say that for pending I -130 the USCIS will adjudicate your petition based on visa availability .... thank god![-o< [smile]

I am not sure why some people are still confused about filing I-485 when I-130 is pending. USCIS allows filing I-485 when I-130 is pending. I may have said this about 50 times in the last one month. o:) BTW, is there any lawyer who says you cannot file I-485 when I-130 is pending? Also the link Swe posted above talks about what would happen to I-130 petition when visa number is available. It does not talk about I-485 application. So I guess it should be the same case this time around :)
