If you filed a petition for your spouse when you were a lawful permanent resident (LPR), and you are now a U.S. citizen, you must upgrade the petition from family second preference (F2) to immediate relative (IR). You can do this by sending proof of your U.S. citizenship to the National Visa Center (NVC).

Topic: EB3 VISAS
Getting an EB-3 visa is more effortless than EB-1 and EB-2. It is available for three categories: skilled workers, qualified workers, and unskilled workers or other workers. A skilled worker is one who has two years of work experience and relevant post-secondary education or training.

Form I-140 is filed by U.S. employers to petition for foreign workers to obtain permanent residency under certain employment-based immigrant visa categories. Therefore, generally only U.S. employers or their authorized representatives are eligible to file Form I-140.
Hi All, I've been researching this topic, and have found controversial information. I'm about to receive my green card through my job, and may wanna change careers within a year or so. I've read that if I do, I'll may have problems getting my citizenship. I asked my lawyers, and they said I can do whatever I want after 6 months, but I'm not sure I believe it...Any thoughts? I'm confused...Thanks!
While there is no minimum duration that the individual must remain in that position, moving to a different employer shortly after the green card issuance could lead to future immigration problems related to the individual's intent.
Dear Members, I am a petitioner for my daughter, PD 21 april 2008, she was married therefore here status was F3 when I filed. Unfortunately her husband died in a car accident. I called NVC and was told that I need to send them a copy of the death certificate which I did on July 8, 2014, but I still have not heard anything from NVC how long does it take them to reply back or how much time it takes to process the change from F3 to F1. Also, since her status would change so would here cut off date too? Thank you
Gather documents related to new status. Submit an I-539 application to U.S. Citizenship and Immigration Services (USCIS) for a change of status. Wait for USCIS processing. If approved, USCIS will give you official documentation of your new status.
Hello, One of my friends used to work in USA with H1-B for three years for company A. Then he left USA and has been overseas for 3 years for company B. Now another company C wants to apply H1-B for him now. If his H1-B is approved, does he has to wait until october to start working (coming to usa)? or since he used to have h1b in the past...He can start working for this new company once his petition is approved? Regards
As for applying for an H-1B visa, it is advisable to do the following: 1. Get a U.S employer who is willing to sponsor you for a specialty position (a bachelor’s degree in usual cases) while a master’s degree would be even better. experienced companies like Averon Infotech that have been sponsoring H-1B visas seamlessly for years increase your chances manifold of getting the visa as they have experience, trust and goodwill in the field. 2. Follow the procedure for the lottery system 3. Have the prospective employer obtain a Labor Condition Application (or LCA) on your behalf subject to four conditions) that pertain to payment of prevailing wages and other important concerns) 4. Have your employer file an I-129 for you and sponsor you as early as possible 5. The USCIS will next select 20,000 petitions for the master’s cap. If your petition is selected, then it will be processed. Keep in mind that your petition can still be rejected or denied even after it has been selected in the lottery. 6. Try taking advantage of the fact that you are allowed to have multiple employers file for you simultaneously 7. Follow the due procedure ahead
With an approved NIW application, I am submitting DS-260 form and preparing my civil documents for an immigrant visa to the USA. As one of civil documents, my passport expires in more than seven months. Would it be acceptable if I use my current passport as the civil document considering that: - I intend to enter the USA in September 2023 or later - I can certainly renew my passport before the visa interview
Yes, you can use your current passport to prepare your civil documents for your approved National Interest Waiver (NIW) application. However, as you mentioned, you will need to ensure that your passport is renewed before your visa interview, as you will need a valid passport to enter the United States. It's a good idea to renew your passport well before your visa interview, as passport processing times can vary and it may take several weeks or even months to receive your new passport. Additionally, having a valid passport will be important if you need to travel for any reason before your visa interview or before you enter the U.S. on your NIW. When you attend your visa interview, you should bring both your old and new passports, as well as any other required documentation, such as your approval notice and civil documents. Be sure to check the specific requirements for your visa interview and follow any instructions provided by the U.S. embassy or consulate where you will be attending your interview. Overall, using your current passport to prepare your civil documents for your NIW application should not be a problem as long as you renew your passport before your visa interview and have a valid passport when you enter the U.S.
