My scenario: my husband has applied for H4 in December 2013 but hasn't received the approval yet. In the meantime, my PD of Jan 12 became current in jan 14 and the lawyers are filing 485 for me soon. The plan is that hopefully if his H4 gets approved in Feb, he can travel here and apply for 485 as well. Do you see any risk with the fact that he sends his 485, leaves the US, travels back for the biometrics and then leaves again using his H4, assuming we are ready to bare the travel cost. Also, My lawyer suggests that he should come back here for the third time soon after His advance parole is approved to minimize any risk with CBP. Any thoughts? I am not sure how does it matter if he travels soon after or later after approval of advance parole?

In relation to post #6 regarding abandonment of AOS if travel before advance parole is approved, is this true even if one travels on H1 or H4?

My pd of Jan 12 (EB3 Row) became current in Jan 14 but haven't been able to file 485 yet. Reasons were confusions regarding my husband's H4 that's being processed outside USA. Finally my lawyers are now preparing the files (485 for me and 824 for my husband for his consular processing) and hopefully will send the forms to USCIS by jan 31st. Does it matter when in Jan one files? Does an application sent in Mid Jan vs End of Jan get processed sooner? What will the impact be if for some reason my lawyers can't send it by the 31st and send it in early Feb? Also, does the application have to be sent by Jan 31st or received by USCIS by the 31st for it to get processed with Jan filings? Any advice will be much appreciated.
