Hello, One of my friends used to work in USA with H1-B for three years for company A. Then he left USA and has been overseas for 3 years for company B. Now another company C wants to apply H1-B for him now. If his H1-B is approved, does he has to wait until october to start working (coming to usa)? or since he used to have h1b in the past...He can start working for this new company once his petition is approved? Regards

The new H1 start date would be in the form sent by USCIS. That would provide the exact start date.

Get a U.S employer who is willing to sponsor you for a specialty position (a bachelor’s degree in usual cases) while a master’s degree would be even better. experienced companies like Averon Infotech that have been sponsoring H-1B visas seamlessly for years increase your chances manifold of getting the visa as they have experience, trust and goodwill in the field. 2. Follow the procedure for the lottery system 3. Have your employer file an I-129 for you and sponsor you as early as possible 5. The USCIS will next select 20,000 petitions for the master’s cap. If your friend's H1-B petition with company C is approved, he can start working for company C as soon as the petition is approved, without waiting until October. This is because he already had an H1-B visa in the past and is considered a "cap-exempt" candidate, meaning he is not subject to the annual H1-B cap.
