Hi, I am in my H1B visa's 5th year end, on paper my visa ends Aug 30 2014 and I have been out of country 109 days + 1 month of unused month in the original application. So total of 4 months can be added to this. My company asked their lawyer to start a PERM application for me, but lawyers are saying that it will go in an audit and we won't get any results from it, so it is better not to file any PERM for me. One more thing is that I am telecommuting, so lawyer says it is more difficult to do it. I have worked for 5 years with this company and now don't have any time to find another job. Can you please give me some information on how can we try to do PERM process that my chances may improve? Please tell me if you need more info on my case... I really need some help...... PERM application can be filed anytime since GC is for future job. It does not matter if you have not yet joined the employer or have been with then for over 15 years. So they could have filed the PERM application even before the applicant has joined the company. They do many checks on the company in PERM process (that may explain the audit).
