Topic: No decision so far after i-485 interview   Go to last post

Thanks guys.. :)

I am guessing the wait period varies depending upon the visa availabilty per respective country. And I also think they are now processing all cases those were filled in August 2013.
You guys can check the processing times in USCIS website and see the cases that are being processed in your respective field offices. For instance, processing times for "Newark, NJ" field office for I-485 is April 2, 2013 as of now.

However,if I were you, I would schedule an infopass appointment if I wouldnt get any update after until 4 weeks of interview.

Good luck guys !!

Swe,

I guess we are in the same boat. I got my GC with 10 years of validity and I am a LPR spouse, married for exactly a year. Your above post dragged my attention and I am little concerned now.

My welcome letter says that my GC is valid for 10 years which is exactly the same as mentioned. SO I didn't bother at all about the validity until i saw your post. What does your welcome letter say about the validity of your GC?

Do you guys think the "conditional GC" clause applies to only those spouses who go through Consular Process?

He said I should get the approval of the forms in a week's time and should get my GC in 2-3 weeks time. When I check my case status for I-130 online at USCIS site,it still says initial review. This is bothering me as well since I dont have clarity as to what is happening and what will happen.

Thanks

Guys,
I got an update from USCIS on Nov 21 saying they had registered my new permanent residence status. Today morning I received another text saying that USPS has collected the mail that contains my card . The tracking shows Nov 29th as the expected delivery date .. Yay..I feel relieved.

FYI: It took me almost 4 months after filing I-485 to get GC.

Wish you guys all the best and hope you will get your GC ASAP.

Guys,
I had AOS interview at Newark,NJ on 10/29/2013. My husband is LPR and I am on F1.
The IO was very friendly and he even didnt ask much questions besides the Y/N questions in form i-485. He then said our case is very easy and looks great. He said he is approving our case and took my i-94. Also he looked up for something (visa number i guess) in the computer and said it is not available. So he handed us a paper saying "our case was held for further review......". But he said i will be receiving my GC in 2-3 weeks.

But it's been three days and i still see my case in "interview and testing". and This is somehow bothering me. What do you guys think? And any idea on how we can know if the visa number is available for my case or not/ or when will it be available? My PD is march 23, 2013 ans i-130 is already approved.

Thanks

Once they contact you, you will inform them that you are doing AOS and give them your 485 receipt number. At that point, they will hang onto the file until USCIS request for it. It may take 3- 4 weeks min for NVC to contact you, so hopefully by then you will have gotten your receipt number.

Guys,

FYI:

I am among one of those who have the similar issue related to AOS.
My benificiary is in US in a valid F1 status. We applied for AOS (F2a- lpr Spouse)and got the acceptance receipt. I got I-130 receipt 3 weeks after i-485 acceptance and it said that "I-130 has been approved and sent to NVC for further processing". I did however include all documents related to F1 along with I-130 form.

So I contacted NVC via email and stated my situation. After 2 weeks they replied back and asked me a copy of my I-130 and then they replied me again saying that they have sent my case back to USCIS. So I think it is a pre-requisite to notify NVC if you are willing to do AOS (in case your beneficiary resides in US in a valid non-immigrant status) or else they will start the process for consular Processing.

Hi everest, could you please post the email address you sent it to... Just so we can check if the case is sent back to Uscis already or I need to send them more information. Thanks..

Hi there,
Email them at [email protected] and write your USCIS receipt number as the "Subject". You also need to mention the name and date of birth of both the "Beneficiary" and "Petitioner". They will reply your email within 2 weeks.

@f2acamer: Do you mind sharing progress on your case? Did you notify NVC/ Did NVC sent your application back to USCIS? What is your current status on the case?

Topic: Case returned to USCIS from NVC   Go to last post

Hi Guys,
I got an email from NVC that they have returned my 1-130 approval package(Spouse of Legal Permanent Resident) back to USCIS. My beneficiary is in the USA and in a legal status. We filled 1-485 on August as the priority date for F2A was current. We had already filled i-130 in March 2013 so the I-130 was pending while we applied I-485.
I have got my EAD approved last week and also have interview appointment scheduled for October 2013.

I am wondering that this is the normal process for the case where beneficiary is residing in the US, as we did notify NVC that we had already applied for AOS and we don't want to go through Consular Processing.

Can you guys share if you have/had any such experiences? Any thoughts wil be highly appreciated.

@Amazon: Do you think it is a normal process or is there anything I need to worry about?

I did the same but it doesn't give any such options and terminates the call. The automated system however says that the "customer service rep are available from 8am-6pm" but never routes the call to them.Believe me i tried all the options. Almost spend 2 hours but no progress. Angry
