Hey guys, I checked my status and saw that I-130 has been approved.. Such a relief.. Yay.. My case was at Vermont Service center with priority date of 3/19/2013. Now waiting for my biometrics appointment next week... :)

Thanks guys.. I am in US as a F1 student and i am still going to college. I applied under F2A category as a spouse of LPR. So my concern is do I still have to maintain my F1 status even after getting my EAD? Any suggestions will be highly appreciated.

Lawyers are conflicted on this. Some say that once applicant on F1 submits I485 application, they are no longer in F1 status. Some lawyers say the opposite - applicants can retain their F1 status even after filing I-485 application. Here is one example (see below): http://www.hooyou.com/news/news062307faq.html There are many laws like this which are not clear (example if a person on H1 has advanced parole but re-enters US on H1, is his new status as H1 or paroled into US).

Your comments/ideas/suggestions in this blog has been very helpful and I really appreciate it. I am also on the same confusion. Have surfed many sites/and done researches on the same topic as I wish I could stop going to school but as you mentioned, there hasn't been a clear idea about it. Hopefully something good will come on my way soon.. [smile] By the way, if Visa bulletin retrogresses in October, how is USCIS going to process i-485? Is it according to the priority date or i-485 receipt date? Since my i-130 is approved and I have fingerprints scheduled for this Tuesday, can I expect an interview in September? Thanks in advance for your reply.

Yeah, even if dates retrogress, USCIS will continue to preadjudicate applications (if they have time - their first priority is to work on applications which are current).

The status is on "post-decision activity" and it says "we have approved your i-130 application and sent you approval notice on 28th August". I received the mail from USCIS and on it says my that my case has been sent to NVC and I will hear from NVC within 30 days for other visa processing steps. I did include I-94, I-20, copy of passport n visa along with I-130 application on March 2013. And filed I-485 along with I-765 this August. Hope this helps.

Hope this helps.[/quote] [/quote] Thanks for response Everest, my 130 was at VSC and transferred to NSC where it was approved on 08/27. I did file I-485/765/131 on 08/01. I completed my biometrics on 08/20. Your situation is similar to mine so we can follow each other's progress. Since you are filing I-485 it means you must have checked on your I-130 application that you are doing AOS in the US. In that case your approved 130 petition should have been sent to NBC where your I-485 is being processed and not to NVC. NVC is for people going through consular processing. Anyways when you received the hard copy of the I-130 approval, USCIS will give you an explanation as to why your case has been sent to NVC instead of NBC. In my case they said the beneficiary could not adjust in the US that is why they are sending it to NVC. That is what got me really confused because the beneficiary is in a valid F1 status in the US and there is no reason why they can't adjust here since the PD for F2A is current. I thought that maybe bc I did not include I-20, I-94, and copy of passport with visa might have made them to forward the approval to NVC. In your case, you included all those things and yet they have forwarded your case to NVC also. Please when you get your approval hard copy let us know the reason that USCIS advances for forwarding your case to NVC. Thanks!

[/quote] I received hard copy of I-130 approval and it says "The above petition has been approved and we have sent the original visa petition to 'Department of State National Visa Center'. NVC determines which consular post is appropriate consulate to complete visa processing. NVC will then forward the approved petition to that consulate." Since I am in the US and maintaining F1 status, I believe my case should have been sent to NBC instead. However my I-485 receipt and I-765 receipt says that my case has been sent to NBC. So i dont know why they sent my approved I-130 to NVC. [confused] [confused]

[/quote] Thanks Amazon.When I filled i-485 this August, I chose option "h" and mentioned "LPR spouse,I-130 Pending and F2A current".I got the I-485 receipt notice and my I-485 is being processed at NBC center now. But Since my I-130 is approved on Aug 29, 2013,and sent to NVC instead of NBC,do I have to notify NBC that my I-130 is approved? And do you think it is a regular process to send approved I-130 to NVC (if the beneficiary resides in US in a valid status) or can that be a matter to worry about?
