First time so not sure if this is right way to put this in. My wife filed I-130 for me back in March this year. I am living in NZ and planning to travel to US in August to file I-485 as the PD is going to be current. I have received the NOA1. I am preparing my I-485 pack now. My wife is currently in NZ and has a Travel Document Re-entry visa. I have a few questions: Does my wife, as petitioner, have to be present in US when I file the I-485? I can enter US under Visa waiver program as visitor. Should I apply for dual intent visa when I arrive in US? After I file the I-485 can I travel out of the US and return again when the appointment is made for the Biometrics? Should I apply for EAD/AP at the same time I file the I-485? to make the travel outside the US easier? Thanks Monty

You may want to talk to a lawyer who can review your case. 3. You have to have specific visas to travel outside US while I-485 is pending. Hi Amazon, I sent my wife's AOS, EAD and AP applications on Aug 01 and received NOA1 for all. I am yet to receive the FP notice. In the meantime, she found that in the AP NOA1 (only in this NOA1), her middle name is given as "N" (She entered NONE in the application). All the NOA1s start with MSC and there are no status info available for the past one week. When called USCIS, they said they could not see her case files in their system and asked her to send a letter explaining the mistake along with a copy of NOA1. My question is, if she gets the FP notice in coming days, will this affect her getting the EAD/AP combo card? Thanks.

USCIS call center cannot find this in their system because it takes few days (to few weeks) to update the system. For FP notice, it should not affect it. Typically they are processed separately.
