Yay!\:d/ I think I found a USCIS link which clearly states the answer to this question http://www.uscis.gov/files/pressrelease/I_130_07_01_04.pdf [b]USCIS will adjudicate your Form I-130 prior to visa availability (or within six months if a visa is immediately available upon filing). [/b] sounds to me that yes we can file [biggrin] What do you think Amazon? The document clearly means to say that for pending I -130 the USCIS will adjudicate your petition based on visa availability .... thank god![-o< [smile]

I am not sure why some people are still confused about filing I-485 when I-130 is pending. USCIS allows filing I-485 when I-130 is pending. I may have said this about 50 times in the last one month. o:) BTW, is there any lawyer who says you cannot file I-485 when I-130 is pending? Also the link Swe posted above talks about what would happen to I-130 petition when visa number is available. It does not talk about I-485 application. Here are few sources which says you can file I-485 when I-130 is pending: 1. Blog: http://blog.mygcvisa.com/2013/07/fb-category-frequently-asked-questions.html 2. [/quote] Why would it be different:-k they did not release any other public notice or any information after the 2004 public notice was released. So I guess it should be the same case this time around :)
