Hi Any idea why only TSC is sending the RFEs and not NSC. Is NSC going to send the RFEs anytime soon, or will they send it only when the dates become current for those applications - If the dates open in Sept and NSC starts sending the RFEs, by the time the applicats send the responses Sept might be done and dates retrogress back? Appreciate your comments. Thank you.

However this data is as of April 30. So it seems that TSC is now "catching up" to NSC. Thank you.[/quote] Yes that is very likely. If NSC starts issuing RFE in September (instead of July or August), there may not be enough time to respond back before FY 2014 starts in October. USCIS is been proactive and issuing RFE for some applicants till Aug 2008 even though dates have not moved yet. This could mean that applicants from NSC who havent received RFE so far either (a) already got it (b) may not receive it or (c) may still receive it (especially when PD is current).

Thanks for the clarification. Per (b)may not receive it - Is there a possibility to approve even if they don't send the RFE if the case is already pre-adjudicated or is it standard now to send the RFE if it has been long time since pre-adjudication and then only approve the application? If this is the new standard - shouldn't they be atleast sending the RFEs in order of PD rather than randomly sending to Aug 2008 PDs also and leaving prior PDs. I have a March 2008 PD - NSC - didn't receive RFE - Wondering what are the possibiities of getting approved this year? Appreciate your comments. Thank you !!

Sending RFE to applicant is fully at the discretion of the officer reviewing the case. Some officer may not decide to send RFE; whereas other may decide to send it for anything (employment letter, EAD, medical, etc). Regarding how far dates could move in Sept VB, it depends on two main factors: (a) amount of spillovers from other EB categories and (b) amount of porting.
